These Terms of Use ("Terms") govern your access to and use of the website imagick.tech and the associated applications AiFixer, iMagick, and VideoFinder (collectively, the "Services") operated by MV Holding, MB ("we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our Services, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not use the Services.

2. YouTube Terms of Service

Our VideoFinder service uses YouTube API Services. By using VideoFinder or any part of our Services that displays YouTube content, you are agreeing to be bound by the YouTube Terms of Service.

3. Description of Services

We provide the following Services:

  • AiFixer — an AI-powered tool that optimizes product titles for SEO in bulk.
  • iMagick — a bulk image optimization tool for Shopify product images.
  • VideoFinder — a video search tool that uses YouTube API Services to find product-related videos.

4. User Accounts

Some features of our Services require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Services
  • Interfere with or disrupt the Services or their infrastructure
  • Use automated tools to scrape, crawl, or extract data from the Services beyond their intended functionality
  • Violate any third-party rights, including intellectual property rights
  • Redistribute, resell, or sublicense YouTube content or data obtained through VideoFinder

6. Intellectual Property

All content, trademarks, and intellectual property on the Services are owned by MV Holding, MB or their respective owners. YouTube content displayed through VideoFinder remains the property of the respective content creators and is subject to YouTube's terms.

7. API Usage

If you access our API endpoints, you agree to the rate limits and usage restrictions we impose. We reserve the right to suspend or terminate access for any account that violates these limits or engages in abusive behavior.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, MV Holding, MB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Services after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.
